This time round, the discussion was all about rightsizing, where adept HR practitioners and legal professionals took the attendees through the ropes on rightsizing and downsizing.<\/span><\/p>\n<p><span style=\"font-weight: 400\">The keynote speakers gave great insights into the role of the HR in ensuring that rightsizing and downsizing are done right. The main themes of the discussions were:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Continuous rightsizing practice<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Rightsizing: The legal aspects<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Redundancy<\/span><\/li>\n<\/ul>\n<h3><span class=\"ez-toc-section\" id=\"Continuous_Rightsizing_by_Denis_Nyongesa_HR_Director_Ramco\"><\/span><b>Continuous Rightsizing by Denis Nyongesa, HR Director, Ramco<\/b><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-3846\" src=\"https:\/\/www.brightermonday.co.ke\/discover\/wp-content\/uploads\/2017\/07\/Continuous_Rightsizing_by_Denis_Nyongesa_HR_Director_Ramco.png\" alt=\"BrighterMonday's HR Forum\" width=\"848\" height=\"277\"><\/p>\n<p><span style=\"font-weight: 400\">The first session was by Denis Nyongesa, an experienced HR practitioner in the manufacturing sector. Mr Nyongesa took the attendees through the ropes on right sizing, which he described as a continuous process of reorganising jobs and human resources, to meet the changing needs of the organisation. He highlighted the following salient points in the process of rightsizing:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Annual manpower planning is critical as it forms the basis on which decisions of hiring or reduction of job roles are based <\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">It is based on annual strategy of the company cascaded to the department &nbsp;<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Jobs are described to fulfil the needs foreseen<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Some jobs may be scrapped or created due to change in strategy for the year.<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Employees are supported through training to take up multiple roles <\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400\">For rightsizing to be effective, it is important to realise that it is a continuous process which involves:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Periodic job evaluations &nbsp;<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Conducting regular job profile audits &nbsp;<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Conducting periodic job analysis<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400\">From Mr Nyongesa\u2019s presentation, it emerged that right-sizing should be a continuous process and not a project. He presented it as a process of constantly reorganising the organisation\u2019s human resources to meet the changing needs of the organisation. However, sometimes rightsizing takes place as a project, in the form of downsizing. <\/span><\/p>\n<h3><span class=\"ez-toc-section\" id=\"Redundancy_by_Eric_Kariuki_A_Senior_Consultant_at_Richemele_International\"><\/span><b>Redundancy by Eric Kariuki, A Senior Consultant at Richemele International<\/b><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-3847\" src=\"https:\/\/www.brightermonday.co.ke\/discover\/wp-content\/uploads\/2017\/07\/Redundancy_by_Eric_Kariuki_A_Senior_Consultant_at_Richemele_International-1.png\" alt=\"Redundancy\" width=\"848\" height=\"277\"><\/p>\n<p><span style=\"font-weight: 400\">Having established that sometimes, rightsizing involves downsizing, the next speaker was a skilful talent planning, organisational design, resourcing and employee management HR practitioner who took the attendees through the process of downsizing. According to Mr Kariuki, redundancy has 3 main characteristics:<\/span><\/p>\n<ol>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">It targets jobs<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">It is caused by restructuring and insolvency<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">The reason for restructuring or insolvency may be technological, economic or operational<\/span><\/li>\n<\/ol>\n<p><span style=\"font-weight: 400\">When carrying out redundancy, it is important to follow the following steps to make the process as smooth as possible:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Communicate with the entire organisation on the reason for the redundancies, the process and proposed timelines, and the available support to those who will be affected<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Consult widely and notify all the employees, the affected employees, and third parties such as labour unions, labour officials, and lawyers where necessary<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Review and prepare employee file, policies and legal provisions, termination documents, and communique<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Process and execute notifications, termination letters, handover process, and terminal dues<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Support the redundant employees through assisted job search, and referrals<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400\">Before declaring an employee redundant, it is important to consider the following options;<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Redeployment<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Secondment<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Rehiring<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Job enlargement<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">retirement<\/span><\/li>\n<\/ul>\n<h3><span class=\"ez-toc-section\" id=\"Rightsizing_The_Legal_Aspects_by_Jacob_Ochieng_a_partner_at_Oraro_Co_Advocates\"><\/span><b>Rightsizing: The Legal Aspects by Jacob Ochieng\u2019, a partner at Oraro &amp; Co. Advocates<\/b><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-3848\" src=\"https:\/\/www.brightermonday.co.ke\/discover\/wp-content\/uploads\/2017\/07\/Rightsizing-The_Legal_Aspects_by_Jacob_Ochieng_a_partner_at_Oraro__Co._Advocates.png\" alt=\"Legal aspects of downsizing\" width=\"848\" height=\"277\"><\/p>\n<p><span style=\"font-weight: 400\">Next on stage was an accomplished advocate who gave the HRs in attendance the legal frameworks in downsizing. Declaring employees redundant is a legal process and if not done right, it could lead to serious legal problems for employers. According to Mr Ochieng, the legal framework governing redundancy is covered by:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">The Kenyan Constitution, 2010<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">The labour relations act, 2007<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">The employment act, 2007<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">ILO conventions<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Case law<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400\">The redundancy process is covered by section 40 of the employment act and it is very particular about:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">The process of giving notices<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">The selection criteria for the employees to be declared redundant<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">The redundancy benefits that the employees should enjoy<\/span><\/li>\n<\/ul>\n<h3><span class=\"ez-toc-section\" id=\"An_Insight_into_Technology_and_HR_Solutions_by_Joseph_Mathenge_Chief_Information_Security_Officer_at_Airtel_Africa\"><\/span><b>An Insight into Technology and HR Solutions by Joseph Mathenge, <\/b><b>Chief Information Security Officer at Airtel Africa<\/b><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-3849\" src=\"https:\/\/www.brightermonday.co.ke\/discover\/wp-content\/uploads\/2017\/07\/An_Insight_into_Technology_and_HR_Solutions_by_Joseph_Mathenge_Chief_Information_Security_Officer_at_Airtel_Africa.png\" alt=\"Technology and downsizing\" width=\"848\" height=\"277\"><\/p>\n<p><span style=\"font-weight: 400\">The final presentation was by Joseph Mathenge, an accomplished systems analytics practitioner who gave insights into how technology affects and assists HR. His main points were:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">During redundancy, those affected should be given sufficient notice and in the course of the week so as to reduce chances of them leaving with data<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">HR should coordinate activities well with the systems administrator to ensure that the necessary rights of access to information are revoked on time<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Data security should always be a priority to avoid compromising the company<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">All computers used on the system ought to be closely monitored to avoid having cases where data is illegally shared or used, thus, personal computers should not be used for work and outside work<\/span><\/li>\n<\/ul>\n<h3><span class=\"ez-toc-section\" id=\"Panel_Session\"><\/span><b>Panel Session<\/b><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-3850\" src=\"https:\/\/www.brightermonday.co.ke\/discover\/wp-content\/uploads\/2017\/07\/The_4th_edition_of_the_quarterly_HR_forum.png\" alt=\"HR Forum\" width=\"848\" height=\"277\"><\/p>\n<p><span style=\"font-weight: 400\">At the end of the session, a panel consisting of the 4 keynote speakers and Judith from Oraro &amp; Co advocates handled questions from the attendees. It emerged that the process of rightsizing and downsizing is often challenging and there needs to be more information on the best practices.<\/span><\/p>\n<p><span style=\"font-weight: 400\">It was a very engaging session and the attendees gained a lot of information.
